
RICHARD B. HAJDUK, LLB
Richard B. Hajduk is a
partner of the firm. Mr. Hajduk attended the University of Alberta and
received his Bachelor of Laws in 1987.
Mr. Hajduk moved to the
community of St. Paul in 1987, and merged his practice of law with that of
Mr. Vital Ouellette in 1988 forming the Partnership of Ouellette &
Hajduk. From 1990 to 1995, Mr. Hajduk was also the Chairman of the Board of
Directors of the St. Paul and Smoky Lake Regional Business Development
Centre Corporation. The objective of the Corporation was to promote and
assist trade and commerce within the towns and counties of St. Paul, Smoky
Lake, and the Goodfish Indian Reserve thereby enhancing and expanding the
range of goods and services available to its residents. Mr. Hajduk was also
a director of the Economic Development Board for the Town of St. Paul until
his relocation to the City of Edmonton in 1995.
Mr. Hajduk developed an
extensive general practice of law in the Town of St. Paul and frequently
appeared before the courts on behalf of Alberta Social Services in
prosecutions of child protection matters under the Child Welfare Act, and
by special appointment, on behalf of Alberta Justice to prosecute criminal
matters and on behalf of Canada Justice to prosecute drug related offences.
Mr. Hajduk relocated his practice to the City of Edmonton effective
September 1, 1995, to concentrate his practice in the area of Civil
Litigation.
On June 1, 1997,
Richard joined in a partnership with Rodger C. Gibbs to form HAJDUK &
GIBBS, which carries on the practice of law formerly carried on by HAJDUK
LAW OFFICE. The firm's practice concentrates primarily on Civil Litigation
where the emphasis remains on Personal Injury Litigation and where the firm
now compromises 6 lawyers with 3 support staff.
Mr. Hajduk is a member
in good standing of the Law Society of Alberta and an active member of the
Association of Trial Lawyers of America where he has received the
designation of an advocate. Richard is also a member of the Alberta Civil
Trial Lawyers Association and the Alberta Criminal Trial Lawyers
Association. Mr. Hajduk has extensive legal and business experience and is
also a director of several private corporations.
Mr. Hajduk is an
experienced litigator whose advocacy skills have been refined in the
crucible of hundreds of trials before the Alberta Courts. He has also
represented clients' interests in Alberta, British Columbia and the
Northwest Territories and before various administrative tribunals including
the Alberta Human Rights Commission, the Farm Debt Review Board, the
Workers' Compensation Board, Metis Settlements Appeal Tribunal and
Municipal Boards of Health.
His extensive base of experience includes providing advice and litigating issues on a wide range of Aboriginal matters involving aboriginal rights, internal governance, claims, election disputes, membership matters, commercial, corporate and oil and gas law and joint ventures with other business ventures. He has provided advice pertaining to an extensive range of employment related matters, including the preparation of employment contracts and litigation relating to wrongful dismissal. Mr. Hajduk has also assisted our aboriginal clients in their administration and management of human resources.
Recently, Mr.
Hajduk also successfully litigated a case involving the sexual assault of a
young child while at a Boy Scouts Camp in Skeleton Lake Alberta. In that
case Mr. Hajduk was successful in having the Court make a determination of
negligence not only against the offender, Mr. Frederick Miller, but also
against The Boy Scouts of Canada who were found negligent. This case was
the first in Alberta to establish a duty of care for third parties to
protect children from sexual assault.
