Sexual Abuse / Sexual Assault

In a recent case, the firm was successful in having the Court find liability against the operator of a lakeside retreat for children. The camp operator was found negligent and liable when the Camp Chief witnessed an adult fondling a 5 year old child in a sexual manner, and failed to intervene or report the matter to the child's parent or to the police or to a social worker. The wrongdoer, who had previously been convicted in criminal court, was also found liable. Richard B. Hajduk was counsel for the Plaintiffs (the Child and his mother) at the trial.

Civil Litigation

In a recent case, the firm was successful in defending a case against a motor vehicle storage company who was sued by the owner of a tractor / trailer. The police had seized the tractor / trailer and its cargo under suspicion that the cargo had been recently stolen, and had the tractor / trailer and cargo stored at our client's storage facility. The Court dismissed the claim against our client and allowed our client's counterclaim for its storage bill in full, together with costs on a solicitor and client basis. Rodger C. Gibbs was counsel for our client at the trial.

Charter of Rights and Freedoms

In a recent case, the firm was successful in having the Metis Settlements Appeal Tribunal decide that a section of the Alberta Metis Settlements Act was invalid as it unlawfully discriminated against a Metis Woman on the basis of sex and marital status, and could not be justified in a free and democratic society. This finding allowed the Woman to become a full member of the Metis Settlement where she and her parents and family had lived most of their lives. The Alberta Government had intervened and argued that the Metis Settlements Appeal Tribunal did not have jurisdiction to hear a Charter of Rights and Freedoms argument and grant relief in a case coming before it. The firm was also successful in arguing that the Metis Settlements Appeal Tribunal had jurisdiction to decide such cases. Richard B. Hajduk was counsel for the Metis Woman and the Metis Settlement at the hearings before the Metis Settlements Appeal Tribunal. Rodger C. Gibbs provided provided litigation support in researching the applicable Charter of Rights and Freedoms and Constitutional case law and writing briefs of legal argument.

Personal Injury

In a recent case, our client was a claimant regarding a motor vehicle accident in which she was injured. The Defendant attempted to blame our client in whole or in part for the collision. The firm was successful in proving that the Defendant was 100% at fault for the collision, and that our client was not at fault.
